Welcome to thepoolservicecompany.com. These Terms & Conditions (“Terms”) govern your use of our website and outline the agreement for the pool cleaning, maintenance, and repair services provided by The Pool Service Company (“we,” “us,” or “our”).
By accessing our website or hiring us for services, you agree to comply with and be bound by these Terms.
1. Services Provided
The Pool Service Company provides residential and commercial pool cleaning, water balancing, chemical treatment, leak detection, and equipment maintenance. The specific scope, schedule, and frequency of your service will be outlined in your individual service agreement or quote confirmation.
2. Billing, Payments, & Invoicing
- Payment Terms: Invoices are generated electronically and sent to the email address provided. Payments are due upon receipt or by the specific due date indicated on the invoice.
- Payment Methods: We accept major credit cards and electronic payments via our secure payment gateway.
- Late Fees: If payments are not received within 15 days of the invoice date, a late fee may be applied to your account, and services may be paused until the balance is paid in full.
- Rate Changes: We reserve the right to adjust our monthly service rates with at least 30 days’ advance notice to our recurring clients.
3. Property Access & Customer Responsibilities
To ensure we can provide exceptional work and maintain our high standards, customers must fulfill the following responsibilities on their scheduled service days:
- Safe Access: The customer must ensure our team has safe and unobstructed access to the pool area, including keeping backyard gates unlocked.
- Pets: All pets must be secured indoors or away from the pool enclosure during the service visit.
- Water & Power: The customer must maintain functioning water and electrical utilities near the pool area to allow for filter cleaning, vacuuming, and water refills as needed.
- Water Level: The homeowner is responsible for maintaining the pool’s proper water level between our service visits. Low water levels can damage pool pumps and equipment.
4. Liability & Equipment Disclaimers
- Pre-existing Conditions: The Pool Service Company is not responsible for structural degradation, cosmetic staining, or equipment failures that occur due to age, manufacturing defects, or pre-existing conditions.
- Inclement Weather: In the event of severe weather (such as Florida heavy storms, high winds, or hurricanes), services may be abbreviated or rescheduled to ensure the safety of our technicians. Chemical balancing will be prioritized during stormy seasons.
- Algae Treatment: While we maintain standard chemical balancing, unforeseen external factors (such as heavy swimmer loads, excessive rain, or faulty equipment run-times) can cause chemical imbalances. We are not liable for sudden algae blooms beyond our scheduled treatment control.
5. SMS & Communications Policy
By providing your phone number on our website’s contact forms, you explicitly consent to receive operational communications, scheduling alerts, and service updates via SMS.
- Message and data rates may apply.
- Message frequency varies based on your service schedule.
- You can opt-out of text communications at any time by replying STOP to any message. Reply HELP for assistance.
6. Cancellation & Termination
Either party may terminate a recurring service agreement at any time by providing at least 7 days’ notice via email or phone. If you need to skip or reschedule a single weekly cleaning, please notify us at least 48 hours in advance to avoid a service call fee.
7. Governing Law
These Terms shall be governed by, interpreted, and enforced in accordance with the laws of the State of Florida, without regard to its conflict of law principles.
